Three documents answer the question of who can buy a microneedling cartridge or an Ultherapy transducer in the US, and each answers it in a different register. The device label carries either "Rx only" or a federal caution sentence from 21 CFR 801.109 with a blank left for the practitioner. A manufacturer's terms add contract conditions, and of the two sets of US manufacturer terms read for this page, Merz's list Ultherapy transducers among the covered products while InMode's buyer representation is worded for the System. A seller's own page may or may not describe a check on the buyer, and one seller's FAQ describes an automatic NPI check while another seller's cartridge card names only a minimum age. This page sets out what each document states, with the date it was read, so you can tell a line of regulation from a contract clause and from a seller's description of its own checks. It does not say what is legal in your state.

What the federal label caution says and what word fills the blank

Under 21 CFR 801.109, a prescription device label carries either "Rx only" or the sentence "Caution: Federal law restricts this device to sale by or on the order of a ___", and the blank is filled with "physician", "dentist", "veterinarian" or the descriptive designation of another practitioner licensed by the law of the state where that practitioner practices, which is why the word in that blank is the first thing to read on your device's instructions.

The text of 801.109, current on eCFR as of September 21, 2026 and read in full on September 23, 2026, is written as an exemption from the requirement of adequate directions for use. It applies to a device that is "not safe except under the supervision of a practitioner licensed by law" to direct its use, and only when all of its conditions (a) through (e) are met. Condition (a) covers possession and sale. Under it, the device is held either by a person "regularly and lawfully engaged in the manufacture, transportation, storage, or wholesale or retail distribution" of it, or "In the possession of a practitioner, such as physicians, dentists, and veterinarians, licensed by law", and it is "sold only to or on the prescription or other order of such practitioner" for use in that practitioner's professional practice. When a seller quotes 801.109 to you, read the exemption conditions in the section itself rather than a summary of them.

The word in the blank differs by document, and the table records it as each document prints it.

The word in the federal caution blank in four device documents, read September 18 to 24, 2026
document who publishes it word in the blank read on
Ultherapy PRIME instructions for use, revision 04.2026 Merz Aesthetics, merzaesthetics.com physician September 19, 2026
SkinPen Precision instructions for use, PN#P5SP064.00 Crown Aesthetics, Dallas, TX, on crownaesthetics.com physician September 24, 2026
Thermage page for health care professionals thermage.com physician September 23, 2026
Thermage CPT technical user's manual the manufacturer's Canadian domain, ca.thermage.com licensed health care professional September 18, 2026

Three of the four documents fill the blank with "physician", including the SkinPen Precision instructions. The official Thermage page for health care professionals also states "The Thermage system is Rx Only" and refers to the Operator Manual (read September 23, 2026), so one brand page uses both forms named in 801.109. The CPT manual's wording, "licensed health care professional", comes from a document on the manufacturer's Canadian domain, and this page does not carry it over to the US channel. Copy the word from the caution on your own device's instructions into the order file, since that is the practitioner category the document names for the device.

Microneedling pens sit under a second regulation with different wording. 21 CFR 878.4430, "Microneedling device for aesthetic use", current on eCFR as of September 18, 2026 and read in full on September 23, 2026, places the device in Class II with ten special controls. One control lists labeling content (handling, needle parameters, reprocessing, disposal and shelf life) and another covers patient labeling. SkinPen's page for providers names this regulation with product code QAI (read September 18, 2026). For a pen, the caution sentence to look for is the one printed in its instructions, as in the SkinPen manual above, so ask the seller for that document with the first order.

What Merz's terms add when the transducer is on the product list

Merz's Terms and Conditions dated September 15, 2026 list Ultherapy transducers among the products they cover and define the customer as the purchasing aesthetic medical practice, its supervising physicians, medical directors and staff, so the clauses written about products reach a transducer order as well.

The product list, read on September 23, 2026, names "the Ultherapy DeepSEE® System and Transducers, the Ultherapy PRIME® System and Transducers", and Merz's official customer terms page linked this September 15, 2026 version on the same day. In a passage read on September 24, 2026, the terms state that "Merz is relying on Customer's representation that Customer is properly licensed and authorized" to administer the products, and that Merz "makes no representations or warranties regarding Customer's authority to administer the Products" in the state or states where the customer operates. On licensing, then, the contract text points to the practice's own representation. Before the first transducer order, check that the license and authorization the representation refers to belong to the practice that will place the orders.

The clauses on products, read on September 23, 2026, set these conditions on ordering, use and resale.

  1. Every order is subject to Merz's credit approval of the customer.
  2. Products are for the customer's professional use with its own patients; Neocutis is the stated exception, which the customer may resell to patients.
  3. Products "must be administered under the direction of a physician", in line with the instructions for use and the medical regulations of the customer's state.
  4. "Merz prohibits the re-sale, rental, or leasing of Products."
  5. "Sale or transfer of Products to third parties for uses unauthorized by Merz" is prohibited, with "diversion" among the listed examples.
  6. Payment is due in full on receipt of the order unless agreed otherwise in writing, and the customer agrees to card charges "including automatic Transducer orders".

Items 4 and 5 are the ones that bear on where transducers go after delivery. The terms prohibit re-sale and transfer to third parties for uses Merz has not authorized, so if your practice holds these terms, read both items before you offer surplus transducers to another practice. For the machine itself, see Ultherapy PRIME machine cost.

Section 11(A), read on September 24, 2026, belongs to the XPERIENCE+ loyalty program. Merz tracks the customer's purchases and "may conduct an audit of Customer's Product inventory (including Ultherapy line counts)" to check that reported program redemptions match product use, which makes it a check on the program's accounting rather than on the identity of the buyer. For orders, Merz's Ultherapy page for physicians at ultherapy.com gives orders@merz.com and a phone number (read September 18, 2026). Keep that address in the order file as the ordering contact the brand site gives to practices.

What InMode's US terms ask of a system buyer and say about consumables

InMode's US Terms and Conditions Addendum to Customer Purchase Agreement, updated July 22, 2026, ask the buyer of a System to represent that it is a practitioner licensed by the law of its state to use or order the use of the System, or that it buys the System on such a practitioner's order, and both sentences of that section speak of the System.

The InMode US terms page, read on September 23, 2026, shows the dates 2023/09/19 and 2026/07/22 and calls the first category "Authorized Practitioner". The section is headed "System Restrictions and Purchase Authority", and its branch for a buyer acting on an order ends with a requirement of "appropriate and applicable licensing for use of the System in Customer's state" (read September 24, 2026). The same document says that federal, state or local law "may restrict the sale of the System to or at the order of a physician", a health care professional, a dentist or another practitioner licensed in the jurisdiction, and that Services are limited to "persons or entities that have received a writing from the Company identifying" them as a customer (both read September 23, 2026). Keep a copy of the addendum in the system file, because the representation in it is worded for the System you bought.

Consumables appear in the same document in the warranty clause, where "Consumables and accessories are warranted for a period of thirty (30) days" from shipment, and in the upgrade terms, where consumables for the original System that the customer holds at the upgrade "will not be replaced by Company or returnable for any refund or other credit" (both read September 23, 2026). Of the two sets of manufacturer terms read for this page, Merz's name the transducers on the product list, and InMode's word the buyer's representation for the System. Before an upgrade, count the tips you hold for the original System and time your last order against the upgrade date. For one InMode platform, see what a Morpheus8 machine costs. See also aesthetic device warranty outside the authorized channel.

What provider pages publish about joining as a provider

SkinPen's official page for providers, read in full on September 24, 2026, states "Product exclusivity: only available to physician-directed practices", so ask Crown Aesthetics whether that line also applies when a practice orders cartridges.

A verification line on the same page reads "SkinPen Connect digitally recognizes and verifies unused and valid ECUs" (read September 23, 2026), so what it verifies is the cartridge. The SkinPen instructions, a document on use, state "This device should only be used under medical supervision." (read September 24, 2026). Crown Aesthetics' official products page sends practices to "Become A Provider" (read September 18 and 23, 2026). Ask the provider team which document sets its conditions of sale before you fill in the form.

Dp Derm describes itself as "Exclusive U.S. Distributor of Dermapen® and Dp Dermaceuticals™" and invites readers with "If you are a medical professional, join the Dp Derm network", with member benefits and a place in its clinic finder (read September 23, 2026). DermapenWorld's US page states "The first step to joining the DermapenWorld family is registering your interest." (read September 23, 2026). Both pages invite you into a provider network, so ask either company for its written conditions of sale before you register. For SkinPen set against other pens, see SkinPen compared with Rejuvapen, MicroPen and SkinStylus. For SkinPen orders, see SkinPen: where to buy and how to order.

What sellers' own pages say about checking the buyer

MedShift's FAQ, read on September 24, 2026, says the NPI a buyer enters at registration is automatically checked for validity and against the registering provider's name, while a Dr. Pen cartridge page at us.drpen.co, read on September 23, 2026, states the product is intended for individuals aged 22 and older and does not state a license requirement, so two seller pages describe who the product is for in different terms.

What four seller pages say about the seller and about checking the buyer, read September 18 to 24, 2026
seller and page read what the page says about the seller or the sale what the page says about the buyer read on
MedShift FAQ page sells exclusively to licensed medical providers and clinics, by its own FAQ the NPI entered at registration is checked automatically; some products may need an additional account set-up form or a copy of a medical license September 24, 2026
MRP.io, Ulthera DeepSEE DS 7-3.0 transducer page (September 18, 2026) and Rejuvapen microneedling tip ten-pack page (September 23, 2026) the transducer page says the sale is subject to FDA rules transducer page: "MRP will verify your status as an authorized purchaser of this item before shipping."; tip page: "we will verify your status as an authorized purchaser" September 18 and 23, 2026
us.drpen.co, A6S 36-pin cartridge card "Authorised Distributors of Dr.Pen", by its own footer, with a US warehouse in Allentown, Pennsylvania and headquarters in Australia "intended for use by individuals aged 22 years and older"; the card does not state a license requirement September 23, 2026
drpen.net, A6S cartridge ten-pack card store run by Bealux LLC, Rio Rancho, New Mexico ask the store whether it sets an age or license condition before shipping September 23, 2026

MedShift's Ultherapy DeepSEE DS transducer card, read on September 23, 2026, showed a regular price of $2,340.00 and described the transducers as "New in box from MedShift supplier Merz North America", which is the seller's account of its source, not a statement by Merz. The FAQ adds that "Nearly all products in the MedShift Rx Marketplace are shipped directly from their partner manufacturers." (read September 24, 2026), again in the seller's own words. When a seller names a manufacturer as its supplier, ask it for a document from that manufacturer that confirms the channel. MedShift places its check at registration and MRP.io places its check before shipping, so ask each seller at which step it checks you and what it asks to see. For what one cartridge costs on three pens, see SkinPen, Dr. Pen and Dermapen side by side.

Questions to put to a seller before the first order

Before the first order, ask each seller which document states who may buy from it, with its date, and what it checks at registration (a state license, an NPI, or neither), because the documents read for this page put that answer in different places, such as a contract clause at Merz and a registration FAQ at MedShift.

  1. Ask for the document that sets the seller's conditions of sale, with its date; Merz's customer terms page, for example, linked a version dated September 15, 2026 when it was read on September 23, 2026.
  2. Ask what the seller checks when you register (a license, an NPI, a copy of a license) and at which step, as MedShift's FAQ spells out for its own registration.
  3. Check whether manufacturer terms you have already signed restrict re-sale or transfer; Merz's terms do, in items 4 and 5 of the list above.
  4. Ask whether consumables bought in this channel carry the manufacturer's warranty and for how long; the thirty days from shipment in InMode's US terms are InMode's figure for its own consumables, so do not carry them over to another brand.
  5. Ask the manufacturer's account team what it asks for when it opens an account.
  6. Write down the word in the blank of the caution sentence on your device's instructions and keep it in the order file.

To see what one more channel puts in writing before you commit, request a quote and ask for the conditions of sale in the same reply.

FAQ

What does "Rx only" mean on an aesthetic device label?

"Rx only" is one of the two label forms that 21 CFR 801.109 names for a device that is unsafe without a licensed practitioner's supervision, and the section accepts the symbol version "℞ only" in its place (eCFR text current as of September 21, 2026). The other form is the longer caution with a blank for the practitioner type. On a label, look for which form appears, and in the caution form, for the word that names the practitioner.

Does Merz check a clinic's license before selling Ultherapy transducers?

Section 30 of Merz's terms dated September 15, 2026, headed "Entire Agreement", places the licensing point on the practice's own statement that it holds the proper license and authorization, and says Merz gives no assurance about the practice's authority in the states where it works (read September 24, 2026). What Merz asks for when an account is opened is a question for its account team.

Do sellers verify a clinic's license?

Seller pages differ. In its FAQ (read September 24, 2026), MedShift expects a verified business holding a valid medical license, an NPI number or both, and says a registration may be rejected when the details cannot be confirmed. An MRP.io transducer listing read on September 18, 2026 places its purchaser-status check before shipment. Ask any seller what happens to your order if its check fails.
